Privacy Policy
Bayleys Property Management recognises the importance of protecting the privacy and rights of individuals in relation to their personal information. This Privacy Policy explains how we collect and manage personal information, which the Privacy Act 2020 (as amended) defines as information about an identifiable individual (Personal Information).
How do we collect your personal information?
We collect your personal information directly from you in ways that may include:
- through your access and use of our website
- by telephone, letter, SMS or email
- during conversations between you and our representatives
- registering attendance at open homes, private viewings and rental viewings
- in the preparation of Agreements for Sale and Purchase of Real Estate
- by contracting with us or completing application forms
- when completing rental applications, ensuring compliance with the Residential Tenancies Act
- by entering competitions, promotions or requesting information or material from us
- participating in competitions, completing surveys, providing feedback or making a complaint to us
We may also collect personal information from third parties (indirect collection), including:
- third-party companies such as credit reporting agencies, law enforcement agencies and government entities
- your representatives (lawyers, accountants and financial advisers)
- your employer
- publicly available sources of information
- any other organisations where you have given your consent
Notification when we collect your information indirectly
From 1 May 2026, the Privacy Amendment Act 2025 introduces a new Information Privacy Principle (IPP 3A) that requires us to take reasonable steps to notify you when we collect your personal information from a third party rather than directly from you.
Where we collect your personal information indirectly (for example, from a credit reporting agency, your employer, or a publicly available source), we will take reasonable steps to ensure you are made aware of:
- the fact that we have collected your personal information
- the type or types of information collected
- the source from which the information was collected
- the purposes for which the information is being collected
- your right to access and correct that information
- whether we intend to pass the information to any other persons or organisations
This notification will be provided as soon as reasonably practicable after collection, unless an exception applies (for example, where you have already been made aware of the collection, where notification is not reasonably practicable in the circumstances, or where another statutory exception applies under the Privacy Act 2020).
This obligation applies only to personal information we collect indirectly on or after 1 May 2026.
For what purposes do we collect, hold, use and disclose your personal information?
We collect personal information about you so that we can perform our business activities and provide the best possible quality of service. We collect, hold, use and disclose your personal information for the following purposes (among others):
- to provide property details and services to you and to send communications requested by you
- to answer enquiries and provide information or advice about our properties and services
- for administrative, marketing (including direct marketing), planning, product or service development, quality control, survey and research purposes
- to provide your updated personal information to our contractors or service providers
- to update our records to ensure your contact details are accurate
- to process and respond to any complaint made by you
- to comply with any law, rule, regulation, lawful and binding determination, decision or direction of a regulator, or in co-operation with any governmental authority
How we use your personal information
We generally use your personal information to assist you with property management services, and where relevant, recruitment and contracting. If you provide your details, we will enter your information into our database and use it to contact you about our services. We may also use information provided via competitions or surveys for research and marketing purposes.
Direct marketing
We may send you direct marketing communications and information about our products and services that we consider may be of interest to you. These communications may be sent in various forms, including mail, SMS and email, in accordance with applicable marketing laws. If you indicate a preference for a method of communication, we will endeavour to use that method wherever practical.
At any time you may opt out of receiving marketing communications from us by contacting us using the details below, or by using the opt-out facilities provided in the marketing communications. We will then ensure your name is removed from our mailing list.
Cookies
A cookie is a small amount of data sent to your browser from a web server and stored on your device. Bayleys Property Management uses cookies for a variety of purposes including enabling more efficient navigation while you use our site. You may be able to configure your browser to refuse cookies, though this may affect your experience on our website.
Third-party links
Our website may contain links to websites operated by third parties. We make no representations or warranties in relation to the privacy practices of any third-party website and we are not responsible for their privacy policies or content. Third-party websites are responsible for informing you about their own privacy practices.
Who we share your information with
Bayleys Property Management will not disclose any of your personally identifiable information except when we have your permission, or to companies related to or providing services to Bayleys Property Management. Where we share information with third-party service providers acting on our behalf, those providers are treated as acting under our direction and the collection is considered direct collection under the Privacy Act 2020.
Your right to access and correct your information
You may access the personal information that Bayleys Property Management holds about you by contacting us by phone, post or email. Your information can be updated, corrected and in some cases deleted at your request at any time. The Privacy Act 2020 places some limits on these rights. If we refuse a request, we will tell you why and advise you of any applicable review rights.
How we protect your personal information
Bayleys Property Management will never rent or sell your personal information. We take reasonable steps to protect the personal information we hold from unauthorised access, use, modification or disclosure.
As our website is linked to the internet, and the internet is inherently insecure, we cannot provide absolute assurance regarding the security of information you communicate to us online. Accordingly, any personal information you transmit to us online is transmitted at your own risk.
Resolving privacy complaints
If our service does not meet your expectations regarding privacy, please contact us directly. We aim to resolve most issues promptly. If we cannot resolve your complaint on the spot, we will acknowledge it in writing and advise you of the expected timeframe for resolution.
If you are not satisfied with the steps we take or the outcome of our investigation, you may seek assistance from the Office of the Privacy Commissioner.

In most cases, we expect to be able to resolve your issue or complaint on the spot. If this is not possible, we'll send you a letter to acknowledge your issue or complaint and let you know how long we expect it to take to provide you an answer.
If you are not satisfied with the steps, we take to resolve your issue or complaint or with the result of our investigation, you can seek assistance from an independent external dispute resolution service, which is provided by the Office of the Privacy Commissioner.
